Welcome to Activated OSHC.
Activated OSHC is an online physical activity and screen time reduction program provided by the University of South Australia (ABN 37 191 313 308) (UniSA) which aims to:
(a) provide educational and training resources to OSHC services for the implementation of the Australian OSHC Physical Activity and Screen Time Guidelines;
(b) facilitate the development and implementation of physical activity and screen time policies within OSHC services; and
(c) establish and maintain a voluntary accreditation framework for OSHC services that demonstrate compliance with program requirements.
The Australian OSHC Physical Activity and Screen Time Guidelines were developed and published as part of a project funded by the National Health and Medical Research Council.
Set out below are the terms and conditions which apply to accessing and using Activated OSHC (Terms).
Please read these Terms carefully before registering for, and using, Activated OSHC.
2. User eligibility
Activated OSHC is available to OSHC services throughout Australia.
3. Accepting these Terms
If you register for Activated OSHC by completing the online registration form and email verification and access Activated OSHC, then there will be an agreement between you and the UniSA for access to Activated OSHC on the Terms set out in this document.
By registering you will be certifying that:
(a) you have read, understood and agree to these Terms;
(b) the information provided by you is current, complete and accurate; and
(c) if you are accessing Activated OSHC for any company or other organisation, you are authorised to do so.
If you do not agree to these Terms, you must not access or use Activate OSHC.
We may amend these Terms at any time. An amendment of these Terms will be effective 30 days after posting the amendment on the Activated OSHC webpage.
If an amendment to these Terms is not acceptable to you, you must discontinue using Activated OSHC.
4. Access
Activated OSHC is accessed via the URL https://activatedoshc.org.au/.
You will be issued with a username and password for accessing Activated OSHC. You must maintain the confidentiality and security of your username and password.
You are not entitled to authorise any other person to use Activated OSHC, unless specifically authorised in writing by UniSA.
You must immediately notify UniSA:
(a) if your username or password is disclosed or potentially disclosed to any other person; and
(b) of any unauthorised access to your Activated OSHC account.
To the extent permitted by law, UniSA has no liability for any losses or damages arising from the unauthorised use of your Activated OSHC account.
You agree not to impersonate or misrepresent your affiliation with any person or entity, including using another person’s username, password or other account information, or another person’s name or likeness when using Activated OSHC.
You agree that UniSA may take steps to verify the accuracy of information you provide in connection with your access and use of Activated OSHC.
5. Subscription
(a) Subscription fee: Activated OSHC is provided by UniSA free of charge. However, UniSA retains the right in the future to introduce fees for Activated OSHC, and if it does so notice will be provided via the Activated OSHC webpage. If fees are introduced which you do not intend to pay, then you must cease accessing and using Activated OSHC from the date on which those fees apply.
(b) Subscription period: Your subscription period will start on you accessing Activated OSHC for the first time. You may continue to access and use Activated OSHC, unless that right is removed under these Terms. You may cease using Activated OSHC at any time.
(c) Additional content and features. From time to time, UniSA may develop and implement additional features within Activated OSHC.
(d) Suspension or termination of subscription: UniSA may suspend or terminate your subscription by providing notice to you if you breach these Terms. UniSA has no liability to you for suspending or terminating your subscription if you are in breach of these Terms.
6. Licence to access and use Activated OSHC
(a) Copyright and other intellectual property rights in Activated OSHC are held by UniSA.
(b) Subject to your compliance with these Terms, UniSA grants you non-transferable, revocable, world-wide, non-exclusive and non-sublicensable licence to:
(i) access and use Activated OSHC within your relevant OSHC for:
(A) educational and training resources to OSHC services for the implementation of the Australian OSHC Physical Activity and Screen Time Guidelines; and
(B) facilitate the development and implementation of physical activity and screen time policies within OSHC services,
(Permitted Purpose; and
(ii) download Activated OSHC content for the Permitted Purpose.
7. Connection and usage [
(a) Use of Activated OSHC requires:
(i) a compatible electronic device with web browsing capability;
(ii) relevant software that may require periodic updates; and
(iii) a high-speed internet connection.
(b) You are responsible for obtaining the means of connecting with Activated OSHC and the costs of this connection.
8. Prohibition on misuse
You must not access or use Activated OSHC in a manner which:
(a) infringes the legal rights of any person or entity (including UniSA);
(b) is illegal;
(c) introduces any malicious computer code or source code, malware, viruses or other threats or impediments to Activated OSHC or UniSA’s IT systems;
(d) harms any person or damages any property; or
(e) transmits, publishes or communicates any defamatory, offensive, abusive, indecent or menacing material.
9. Personal information
When you subscribe to Activated OSHC and create an Activated OSHC account, you agree to UniSA using your personal information for the purposes of your subscription.
Personal information will be handled by UniSA in accordance with the University of South Australia’s Privacy Policy (https://i.unisa.edu.au/policies-and-procedures/university-policies/hr/privacy-policy/ )
Prior to providing the personal information of any other person to UniSA in connection with Activated OSHC, you must obtain that person’s consent.
The term ‘personal information’ has the same meaning as that term under the Privacy Act 1988 (Cth).
10. Data
UniSA may collect, analyse, use and publish data provided to, or generated by, systems used to provide or support Activated OHSC for the purposes of program evaluation and improvement, and research. This may include data in connection with individual account usage of the Activated OSHC website. All data collected, used and stored by UniSA for these purposes will be deidentified.
11. Service disruptions
(a) You acknowledge and agree that your access to, and use of, Activated OSHC may be affected by the performance of electronic devices, networks and software over which UniSA has no control. You agree that UniSA has no responsibility for any service disruption caused by the failure of performance of any electronic devices, networks and software.
(b) You acknowledge and agree that Activated OSHC may not be available for access and use from time to time due to:
(i) maintenance or upgrades;
(ii) power or server outages;
(iii) war, riots, strikes, social unrest or other circumstances beyond the control of UniSA.
(c) UniSA will take reasonable steps to inform you of any anticipated disruptions due to planned maintenance or upgrades.
(d) You agree that UniSA has no liability to you for any disruption to access or use of Activated OSHC.
12. Modification of Activated OSHC
(a) UniSA may alter the features and content of Activated OSHC in its sole discretion at any time.
(b) UniSA will take reasonable steps to notify you of changes to the features and content of Activated OSHC.
(c) You agree that UniSA has no liability to you for any modification of Activated OSHC, including the discontinuance of any feature.
13. Exclusion of implied terms
(a) To the extent permitted by law, UniSA excludes all warranties, guarantees and other terms implied by law from its contract with you in regard to Activated OSHC.
(b) Where an implied warranty, guarantee or terms cannot be excluded, and to the extent permitted by law, UniSA limits the remedies available to you (at UniSA’s option) to resupplying the services.
14. Disclaimer
Activated OSHC is presented ‘as is’ and UniSA makes no representation in regard to the outcomes of using Activated OSHC or the fitness of Activated OSHC for your purposes.
Activated OSHC contains content that is general in nature which does not constitute business or financial advice tailored to your circumstances
Activated OSHC includes content owned by UniSA and third parties. UniSA does not make any representation or provide any guarantee regarding the correctness and accuracy of third party content.
15. Release
You agree that any reliance on, or application of, information, learnings, tools, resources or opinions obtained from Activated OSHC is at your own risk.
By accepting these Terms you release UniSA from any claim, liability or costs arising from, or in connection with, your reliance on, or application of, information, learnings, tools, resources or opinions obtained from Activated OSHC.
16. Notices
You may provide notice to UniSA in connection with these Terms by emailing [email protected].
Notices may be given to you in connection with the Activated OSHC:
(a) for matters relating specifically to your subscription, in writing delivered or sent to a physical or email address you have provided to UniSA; or
(b) for matters relating generally to Activated OSHC, by posting on the Activated OSHC website.
You agree to provide UniSA with your current contact details if these change during your subscription period or on request by UniSA.
